COURT OF CLAIMS.
THE CITY OF CARONDELET,      )
against
THE UNITED STATES OF AMERICA.
The counsel for Carondelet understanding informally
that a motion has been made to dismiss the above-entitled
cause, on the ground that this court has cognizance only
of ioney-deinands against the United States, begs leave
respectfully to represent, in opposition to that motion,
That by the first section of the act to establish a
court for the investigation of claims against the United
States, approved Feb. 24th, 1855, it is (among other
things) provided, that the Court thereby established
shall hear and determine all claims founded upon any
law of Congress, or upon any regulation of an Execu-
tive Department, or upon any contract, express or
implied, with the Government of the United States,
which may be suggested to it by a petition filed therein;
and also all clains w]hio  may be referred to said Court by
either house of Congre.-.
By an act of Congress, approved March 3, 1863, this
act was amended in several particulars. The third sec-
tion cO1ninence,, a. follows:
§ 8. And be it further erweted, That the said Court
