O'CONNOR,
Coram LUDLOW, J.
VS8.
TACK BROS. Philadelphia, November 26.
James O'Connor, sworn.
Called and examined by Mr. Mann.
Q. Relate the circumstances, and all about your complaint ?
A. The complaint I have to make against these men (the Tack
Bros.) is simply they defrauded me out of $30,000, or approxi-
mating to that sum. It occurs in this wise, sir: They were m.
paid confidential agents and I employed them to do a certain
business, and I c tqre tem with having conspired against me.
M lr. Cassidy. Tell me the business. Mr. .ann (interrupt-
ing,) state your relations between these parties, how you came to
employ them and what they did.
A. I came here on the 7th of July, to the city of Philadelphia,
in this year, I called upon Augustus H. Tack, this person (point-
ing to Aug. H. Tack,) who was an Oil Broker, he does business
on Walnut street, he told me he was very largely short of oil;
that is, that he had sold oil deliverable ahead which he did not
have-deliverable at future days, as time contracts, that he had
been doing so for some time past; the market was heavily
glutted with oil, and there were no orders from Europe, to which
the greater portion of Petroleum is shipped, and that the market
would still further decline. He stated, and urged upon me very
strongly, to make time sales deliverable ahead of oil-which is
termed short, that is oil which I did not possess. I am not
in' oil broker or an oil dealer.
31r. Uasmidy. He said all this, did he ?
