THE COMMONWEALTH OF PENNA.
AT the Court of Oyer and Terminer and Quarter Sessions for the
city and county of Philadelphia, March 9th, 1858, the defendant
was tried for the murder of John MCracken, and on the twelfth
day of the same month the jury returned a verdict of  guilty of
murder in the first degree.
March 12th, 1858, motion made for a new trial-rule granted.
Reasons filed. April 2d and 3d, 1858, motion argued.
May 1st, 1858, reasons overruled and rule discharged.
On the first of May, 1858, the defendant was sentenced (vide
record) to death.
On the 26th of May, 1858, the defendant, by his counsel, applied
to the Supreme Court for a writ of error, which writ was allowed-
returnable on the 14th of July, 1858, at Harrisburg.

Greeting: because in the record and process, and in rendering the
judgment in a certain plaint, which was in our said court before the
judges of the said court, by our writ, between the Commonwealth
and John Kilpatrick, an indictment for murder, No. 357, Decem-
ber Term, 1857, of the said court of Oyer and Terminer, as it is
said, manifest error hath intervened to the great damage of the said
John Kilpatrick, as by complaint of the said John Kilpatrick we
