The Return of the said defendants respectfully showeth as follows:
The petition of the relator appears to allege that having com-
mitted no act by reason of which he could be deprived of his mem-
bership as a corporator of the Philadelphia C1ub, he was, on the 24th
of March, 1863, informed that he had been expelled therefrom, and
had then ascertained that a certain number of persons present at a
meeting of the corporators held on the preceding day had passed a
resolution to expel him from his said membership, of which proceed-
ing he had never received any notice.
In answer to such allegations, the defendants would have preferred
to limit themselves to the averment that the relator had committed
such an act as rendered his amotion proper, and that he had received
due and timely notice beforehand of the proceedings which resulted
in such amotion-but being advised that such an averment would form
an insufficient return to the said writ, they are compelled to set forth
particularly the act for which the relator was expelled, the proceed-
ings had thereupon, and the notice which the relator had in the
premises.
For more than twenty years before the passage of its charter of
incorporation, the Philadelphia Club had existed as an unincorporated
association. It was originally formed for purposes of social inter-
course, and it never had any other end or purpose, either before or
