To Honorable GEORGE I. WILLIAMS,
Attorney General, Department of Justice:
SIR: The Constitution of the United States, article 4,
section 4, declares:
The United States shall guarantee to every State in
the Union a republican form of government, and shall
protect each of them against invasion, and on application
of the Legislature, or of the Executive, (when the Legisla-
ture can not be convened,) against domestic violence.
The Government of the United States is thus obligated
to the performance of certain duties: first, to guarantee
to every State a republican form of government, and here
the word State plainly means the people of the State,
whom the United States must make secure against any
form of government not adopted by the free choice of the
people expressed by free suffrage, which embodies our
American notion of a republican form. With this assur-
ance to the people of the State the question is now only
indirectly concerned.
The further obligation of the United States is, in addi-
tion to protecting each State, i. e., the people of each State,
against invasion, to protect them against domestic vio-
lence.
