the rule for a mandamus, must be obvious to every member of the bar.
If the Supreme Court have not any authority to issue a mandamus to
the Courts of Common Pleas, or District Courts, of this Commonwealth,
to compel them to sign a Bill of Exceptions, the jurisdiction of that
Court over all errors not apparent on the Record, is gonL It is not
whether a party may, or may not, have his action against a judge,
who refuses to give him his Bill of Exceptions, but the question is,
whether the Supreme Court is a Court of Errors, or not. As the atten-
tion of the Bar, and the Legislature, seems requisite to the elucidation
of this point, the case is presented for their consideration.
