To the Honorable the Judges of the Supreme
Court.
George W. Edwards, brings this bs bill against James G.
Edwards, Ge,:rge G. Presbury, JaLnus B. Billings and Thorn: Ed-
wards, Jr., and thereupon your Orator complaining saith that in the
spring of 1>-50, he formed the design of erecting in Chestnut Street,
on the premises next mentioned, a large building, to be leased and
used for a boarding house, and that in pursuance of his said design,
and on or about the 30th day of May, A. D., 1<., the complainant
purehas<d from William Chancellor, Henry Chancellor, and James
Brown, executors of the last will of Hannah Chancellor, deceased,
a lot of ground, cntainingz in front on the north side of Chest-
nut Street, east of Ninth Strt-t, fifty feet, and extending northward
to Grape Street, for the price or sum of thirty-three thousand dollars;
and that for motives hereinafter mentioned, he caused the legal title
thereof to be conveyed to his brother, the said James G. Edwards.
That the complainant paid therefor to the said vcndors, eleren thou-
sand dollars of his own money in cash, and he caused the said
James G. Edwards to give them his mortgage- upon said lot for the
remainder of said purchase money, that is to say, for twenty-two
thousand dollars. That afterwards and before the purchase next
hereinafter mentioned, he changed his design aforesaid, and deter-
mined to erect a larger building, to be leased and used as a
hotel, and in pursuance thereof, and on or about the luth day
of August, A. D., 1S.50, he also purchased from Sarah Wharton
Twells, twenty-five feet of ground eastward of and adju-,ining the
above lot, and extending northward to said Grape Street, for the
sum of twenty thousand dollars, and that from the m-'tives herein-
after mentioned, he caused the legal title of said lot also to be con-
veyed to the said James G. Edwards ; and he further shAows, that
of the said last mentioned purchase-money, he paid of his own
money five thousand dollars in cash, and caused the said James G.
Edwards to give for the remaining sum of fifteen thousand dollars
his mortgage on said lot.
Your orator further shows, that soon after he purchased the said
lots, he procured from J. M['Arthur, Jr., Architect, plans, and
caused estimates of the cost of erecting said hotel to be made for him
