STATEMENT OF CASE.
This action was tried at a Circuit Court held in Ithaca,
Tompkins Count3y, on the 16th day of March, 188-2, be-
fore the Hon. William Murray and a jury; and resulted
in a verdict for the defendant, Halliday, Covert not de-
fending.
The action was brought upon a promissory note, which
bears date February 21, 1876, and payable at the
First National Bank of Groton, and signed by Mathew-
son & Cran-, and endorsed by L. J. Covert and Wilson
Hallidav. The action is bron,,ht against these two en-
dorsers. Fol.. S to 14, also fols. 28-29.
There is no issus abont Covert having endorsed the
note. Halliday appears and puts in an answer and he
admits that he endorsed the note in question as his
