STATEMENT.
This action was brought to recover the sum of $950,
which it is claimed was burglariously stolen from the
plaintiff, and subsequently by the alleged burglar,
passed to the possession of the defendant, under circum-
stances which rendered him liable to an action for the
amount with interest.
The defendant is a lawyer engaged in the practice of
his profession at Ithaca, N. Y. The plaintiff is a res-
ident of Indiana County, Pennsylvania. Fol. 2.
Early in the morning of the 7th day of June, 1879,
Win. Sullivan, Chief of Police of the village of' Ithaca,
came to the defendant's house and stated that a man
by the name of Dean, had been arrested for horse steal-
ing on the night preceding; that he was then in the
Police Station and wanted counsel, and bad requested
him to come after and ask the defendant to go to the
Station and see him. During the convrsation, Sulli-
van, in a jocular way, said to defendant that Dean had
lots of money, but perhaps it was counterfiit, and that
