STATEMENT.
The plaintiff herein had a verdict at the Tompkins
County Circuit in October, 1876.  The defendants
made a motion fbr a new trial which was ordered heard
in the first instance at General Term.  The General.
Term of the Third Department denied defendants' mo-
tion with csts, and judgment was thereupon entered
on the verdict. From such judgment, and the order
denying the motion for a new trial, the defendants
bring this appeal.
This action was brought to enfbrce payment of the
fees and poundage claimed by the plaintiff to be due
him on an execution issued and placed in his hands by
the defendants. The plaintiff was the Sheriff of Tomp-
kins county when the cause of action herein accrued,
and when the suit was begun; and the defendants were
a firm of lawyers practicing in the city of Syracuse.
On the 20th day of December, 1873, Warren Halsey
and others recovered a judgment against the Pennsyl-
vania and Sodus Bay Railroad Company for the sum
