FACTS.

On the morning of the 30th day of January, 1874, at
the village of Ithaca, while the Respondent was quietly
pursuing a lawful vocation, he was forcibly seized by
the Defendant, (who was not an officer, and had no
warrant or process of any kind) told by the Defendant
that be was his prisoner, and that he must make no re-
sistance ; compelled to march between the Defendant
and his full grown son, whom he directed to assist him,
