CITY OF BUFFALO, COUNTY OF ERIE.
George Wadsworth being sworn says, That he is one
of the attorneys for the respondent above named, and
has had sole charge of this action for said respondent;
that said action was begun in June, 1874, and that the
same had been defended in good faith; that said action
and the issues joined therein were referred to DeMotte 2
Smith, Esq., an attorney and counselor of this Court, resid-
ing at Trurnansburgh, Tompkins County, N. Y., to hear,
try and determine the same by an order of this Court, made
at Chenango Special Term, August 22, 1876 ; that said
issues were so joined upon a complaint, and answer there-
tofore seived herein.
That said Referee appointed January 16, 1877, as the
day, and his office in Trumansburg, N. Y. as the place,
for~the trial of said action; and that respondent's attorneys 3
duly noticed said cause for trial at such time and place;
that said trial was adjourned, by said Referee, at the re-
qu, st of said respondent's attorneys until January 19,1877
