STATEMENT OF FACTS.
This action was tried before Charles G. Day, Esq., a
Justice of the Peace of Ithaca, Tompkins County, N. Y.,
on the iith day of December, 1878, and a judgment ren-
dered in favor of the plaintiffs' and against the defendant
for $47.85 damages, and $2.85 costs. (Fol's 2 to 8.)
On the 24th day of December the defendant appealed
from said judgment to the County Court of said county.
