TOWNSEND.
This is a motion for a new trial upon Bill of Exceptions,
on the part of the defendants, against whom a verdict for one
hundred and sixty-two dollars was rendered in this court on
the thirtieth day of April last, before his honor Justice Paine,
and a jury. The case comes up on various exceptions to the
decisions of the learned judge, in excluding evidence offered 2
on the trial on the part of the defendants, and also in refusing
to charge certain legal propositions as requested by their coun-
sel.
Statement of Proceedings.
The action was commenced May 14th, 1851. The parties
are the same as when the action was commenced.
The complaint and summons were served on the defendants
respectively on or about the 15th day of May, 1851. The
answer of the defendants was served on the twenty-ninth day
of May, 1851. There was no reply.
The action was tried April 13th, 1852, before Justice Paine 3
and a jury, and a verdict rendered for the plaintiff for $162.
