STATEMENT.
This is an action of ejetrnent brought to recover a
house and lot, situated in the village of Ithaca.
Summons and complaint served, May 15, 1861.
Answer served June 1, 1861, and reply June 17, 1861. 2
Answer denies plaintiff's title and right of possession,
alleges a verbal agreement for purchase of premises and
the payment in full of purchase money and entering into
possession under such purchase, and expending large
sums of money in improvements of said premises.
Also alleges an agreement in writing, dated July 6,
1859, whereby said Coon in consideration of payments
theretofore made, agreed to convey said premises to de-
fendant on request, and that such request was made of  3
plaintiff, and defendant demands by his answer a speci-
fic performance of said contract.
The reply denies the counter claim set up in answer.
The pleadings are all verefied.
On the 16th of Sept. 1861, the issues joined were re-
ferred to Benj. G. Ferris, Esq. as sole referee, for trial.
Cause tried, Feb. 20, 1862, and on subsequent days.
]Referee found for plaintiff, and his report filed June
12, 1862. Judgment entered June 12, 1862.             4
There has been no change of parties.
