Abel here- by appeals from a judgment rendered against him and in favor of the above named plaintiff, on the 15th day of 3 April, 1861, by S. W. Smith, J. P., for $33.63 damages, and $1.37 costs, to the County Court of Tompkins Coun- ty, and assigns the following as the grounds of said ap- peal: 1st. The Justice erred in fixing the amount of dama- ges at $33.63, without evidence of the value of the prop- erty 2d. The plaintiff established no cause of action. 4
