This action was commenced April 5, 1861, in a Justice's 1
Court, and Judgment in favor of plaintiff for 35 entered,
from which the defendant appealed to the County Court
of Tompkins County, where judgment was reversed, and
the plaititiff appeals to this Court. There are no changes
of parties.

Take notice, that the defendant Myndart F. Abel here-
by appeals from a judgment rendered against him and in
favor of the above named plaintiff, on the 15th day of 3
April, 1861, by S. W. Smith, J. P., for $33.63 damages,
and $1.37 costs, to the County Court of Tompkins Coun-
ty, and assigns the following as the grounds of said ap-
peal:
1st. The Justice erred in fixing the amount of dama-
ges at $33.63, without evidence of the value of the prop-
erty
2d. The plaintiff established no cause of action.  4
