In the Matter

Assembly Bill No. 2545 to amend Chapter  Brief against the bill

to provide for the support of the poor in
City of Ithaca, relative to Providing
Funds for the Board of Health.
The objections to Assembly Bill No. 2545, amending An
act to provide for the support of the poor of city of Ithaca 
(1893, chap. 358), are of two classes, namely: (1) Those
involving its constitutionality; and (2) Those involving
questions which relate to its propriety or expediency. Each
class of objections will be presented under a separate point
in this brief.
POINT ONE.
THE BILL IS REPUGNANT TO THE                CONSTITU-
TION, AND, SHOULD IT BECOME A LAW, THE
STATUTE WOULD PROBABLY BE ANNULLED
BY THE COURTS.

First. The bill was not legally accepted by the city.
As Ithaca is a city of the third class, such a  bill shall
not be deemed to have been accepted by such city, unless the
mayor and a majority of the legislative body shall concur
in such acceptance. (The General City Law 1900, chap.
327, § 33.)
