This was an action by plaintiff to recover of defendant for q
the wrongful taking from plaintiff certain personal property of
the value of $1161, with interest from the '15th day of April
1856.
Summons and Complaint served May 24th, 1856.
Answer received June 3d, 1856.
Referred to Samuel P. Wisner, Esq.
Referee reported in favor of defendant February 191, 186-7.  -2
Judgment entered February 18, 1857.
There has been no change of parties.
The Complaint alleges that on the 15th April 1856, the de-
fendant forcibly and wrongfully took from the possession of plain-
tiff certain articles of personal property therein described, of the
value of $1161, and demanded judgment for that sum, with in-
terest from 15th April 1856, and costs.
The Answer,
1st. Denies each and every allegation of complaint.     3
2d. Alleges that Elbert L. B. Curtis on 2!th February 185A,
recovered a judgment in the Supreme'Court against Daniel H.
Brink, Jr., for $204,08 ; that on 25th March, 1856, William S.
Conant and'Charles P. Cone, obtained judgment against sdid
Brink, Jr., for $1045,92 ; and that executions on such judgi~aents
were issued to the defendant as Sheriff, and that he levied such
execufions on the property mentioned in complaint as the prop- 4
ert'y of said Brink.
