The facts in this case sufficiently appear from the
opinion of the court.
The case was heard at Montpelier, before Chief
Justice PIERPOINT, and Judges BARRETT, ROYCE, RED-
FIELD, Ross and POWERS.
Judge DUNTON, having been of counsel did not sit.
It was argued by Messrs. A. B. Gardner and C. N.
Daven'port (with whom were Messrs. T. Sibley and .
B. Meacham), for the orators.
And by T. W. Park, in perso , and E. J. Phelps
(with whom was G. I. Harman), for the defendants.
The opinion of the court was delivered by
POWERS, J.-At a Special Session of the Legislature,
held in March, 1867, an Act was passed entitled An
