In the matter of the probate of the HASWELL, Surrogate. last will and testament of. Benjamin F. Smith, (Examined by COCHRANE) for pro- ponents, testifies : I reside in the city of Albany ; I am 1 67 years old ; I am an architect; I knew Blandina Dud- ley in her lifetime; I knew Mrs. Dudley when her husband was living, and done work for him ; knew her some 20 years or more ; she was the widow of Charles E. Dudley ; I was well acquainted with her husband ; I am a sub- scribing witness to the will now shown to me, purport- ing to be the last will and testament of Blandina Dudley ; I saw her sign her name at the end of the instrument; it was done in my presence; I saw her when she wrote it; at the same time Col. Robert H. Pruyn subscribed it be- 2 fore me, in my presence and in hers; at the time Mrs. Dudley subscribed the instrument, I don't recol- lect of any particular declaration; she was asked if the will should be read; she said she had read it, and this was before she signed it; I signed it as a subscribing witness, at her request; Mr. Pruyn subscribed it at her request; at the time she subscribed it, she declared it to be her last will and testament, in my presence and hear- ing, and in the presence of Pruyn ; the will was read by Mr. Pruyn before it was subscribed by her; he read it 3 entirely through; she was at the time she signed it in mind as sound as mine is at this time, for anyihing I
