THIS cause comes before the court upon an appeal,
taken by certain of the creditors of the petitioner and by
the syndics, in the name of the mass of creditors, from a
judgment rendered by the court for the first district,
allowing the opposition filed by the children of the peti-
tioner to the tableau of distribution, and decreeing them
to be creditors, having a legal mortgage for the sum of
about 54,000 dollars. The appellees claim as heirs of
their mother, Mary Saul. They allege that at the time
of her death, in 1819, their father, the petitionerwas pos-
sessed of property to the amount of 144,245 dollars,
which had been acquired by him in community with
their deceased mother, and that upon her death they
became entitled to one half of that property, and that
the petitioning debtor having retained possession
thereof, they are his creditors for that amount, and
have a tacit mortgage upon his estate. They also rely
upon a notarial act passed by the petitioner in the year
