The defendant, George W. Jones, having made
a motion at this court for an order setting aside
and quashing the writ of certiorari granted by
Justice Westbrook on the 2G;th day of May, 1879,
filed in Saratoga County Clerk's office May 27, 3
1879, and all proceedings thereunder; and also
the order of Justice Westbrook granting said writ
of certiorari, and for the re-arrest of the defendant,
and on reading and filing the affidavit of S. Fort
Brott, G.H. -Maxon, J. S. L'Amoreaux and James P.
Butler, on which said motion was founded ; and
on reading the writ of certiorari and the affidavits
