Alleged Incest of a Father on two of his Dough-
ters-Brutality and obscenity upon a third-
Escape of one of the daughters from Justice-.
Wonderful and surprising details.
On Saturday, April l1th, 1846, Daniel H. Burt-
nett, broker of Wall-street, appeared at the Lower
Police Office. New-York City, accompanied by
two of his sisters named Almira Burtnett an-

formerly a Painter in the Bowery. fie informeA
Jbitice Osborn that %hey were children of Daniel
Bortnett, a wealthy butcher, residing at 342 Bow-
ery, whose continuous brutality to his sisters had
at lenfgih dompelked them, though reluctantly, to
pieat to the protection of the law. That his
sister Almira had attended to 'allege a complaint
against their father for an aggravated assa  and
battery committed upon her in the morning; but
that there were other more heinous offences that
hWd been perpetrated by him  which the elder
stWr Mrs. .ane Ann Waddell, had also, at
lefngth, felt it to' b6 her duty it expose, and
among them would be found the unnatural and
:revolting timi of incest with his daughters !
. After a furtherlrelation'of particulars, in which
it appeared that the allegationi made were based
upon testimony ready to be delivered, the' magis-
trate commenced the investigation, by taking the
following affidavii of Mrs Jane Ann 'Waddefl,
the elder sister:

A~eing duly sworn,, deposes and says :-Is single,
and the daughter of Daniel I-L Burtnett, of 342
Bowery: that on or about fifteen or sixteen
I onto since, the said Daniel H. Bltrtnett, the
TPon ,ent's natural father, as aforesaid, did yvick-
edly, feloniously and with a full intent and pur-
pose, and against this deponent's will, and in des-
pite and contrary to her utmost'resistanre have
criminal and incestuous connection with depo-
nent. And deponent- further saitda that the qaid
Burtnett, the deponent's natural father has from
time, to time, and at various times during and

within the last ten years committed gross and
violent and incestuous connection and had crim.
inal intercourse with this deponent, ever and at
each and every time contrary to and against this
deponent's will as aforesaid. Deponent also states
that the said Burtnett has at different and several
times from, and aincelthis deponent has been'
fifteen years of age, violated, and at other times
attempted to violate this deponent. Deponent
also adds that she has two sisters each younger
than this deponent, (one of the age of twenty-
four years and the other of the age of eighteen
years) both of whom have (each for herself) in-
formed this deponent and-given her to know, that
the said Rurtnett, this deponent's natural father
and the natural father of both of the aforesaia
sisters, has also had improper intercourse and'
lascivious connection with them severally at
several and various times, and contrary to their
will and desires- all of which this deponent
fully believes. Dieponent prays that the said;
Burtnett may be arrested and dealt with, as the
law directs.

SpecialJustice.
An affidavit was also made by Almira Burtnett,
another daughter of 4he- accused, charging him
,with an assault and battery on her person.
The case was then adjourned and -a warrant
issued,for the apprehension of Daniel Burtnett,
the accused.
At the next meeting of the court he appeared'
with his counsel, N. R BLUNT, Esq., and the ex-.
amination was then commenced.
Jane An  Waddell, being sworn and examin-
ed by the-Counsel for, the defence stated-I am
;27 years of age ; reside at 113 Forsyth Street and,
have resided there since the 4th day' of Odobeir
last: I am a widow; was married during the
'winter of, the, big fire; my husband's name was
Allen Waddell-he died three years ago. I re-
Wide l with my father till my marriage when Ilived
with my husband at No. 5 Bleecker Street where
we remained about a year and a half--we then
removed to the2d Avenue near 4th Street where
