                MEMORANDUM
                      on
the Report of the Judiciary Constitutional Convention
       -Submitted to the Legislature by the
             City Club of New York.

TO THE  LEGISLATURE:
  The City Club of New York begs leave to submit
the following observations and suggestions in re-
spect of the Report and Supplemental  Report of
the Judiciary Constitutional Convention of 1921.

  While we  regret that the Convention did not see
fit to propose for consideration a plan for the
appointment,  instead of the election, of judicial
officers, and a plan for the unification of all the
courts of the State, we  think that most of the
proposals  made  by  the Convention   should be
adopted. Particularly to be commended is the pro-
posal for the extension of the jurisdiction of the
Court  of General  Sessions and  the  unification
therewith of the County Courts in the Counties of
Kings,  Bronx,  Queens  and Richmond,   and the
city-wide extension of the jurisdiction of the City
Court  of the City of New York  and the increase
in the maximum   sum  cognizable in that court.

   We  must  deprecate the plan of  the Conven-
 tion to imbed in the Constitution detailed regu-
 lations in respect of every aspect of the jurisdic-
 tion conferred upon the Court of Appeals.  The
 details should be left to legislative regulation as
 was done by the Constitution of 1894.

   It seems to us that aside from the adverse view
 expressed by  the Convention in  respect of the
 fundamental  reforms to which we  have  already
 advetted, the most conspicuous and unfortunate
