PRIVATE CHAPTER NO. 1
HOUSE BILL NO. 690

AN ACT to amend Chapter 90 of the Private Acts of 1991; as amended by
Chapter 207 of the Private Acts of 1992; and any other acts amendatory thereto, relative
to the charter of the City of Celina.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Chapter 90 of the Private Acts of 1991; as amended by Chapter
207 of the Private Acts of 1992; and any other acts amendatory thereto, is amended in
Section 2.01 by adding the following new language at the end of the section:
Candidates for the office of mayor and aldermen of the City of Celina shall have
lived within the limits thereof for a period of twelve (12) consecutive months
previous to being eligible to run for such offices, and shall be qualified voters in
the city. Any person elected to the office of mayor or aldermen shall go before a
magistrate, the clerk of the county court of Clay County, or before any other
person qualified under the laws of Tennessee to issue oaths, and shall make and
subscribe to an oath as well, truly, impartially, and faithfully discharge the duties
of their respective office, which oaths shall be filed with the recorder.
All registered voters who live within the corporate limits of the city, and all
registered voters who reside outside the boundaries of the city who own real
property within the city limits consisting of a minimum value of two thousand five
hundred dollars ($2,500), as determined by the appraised value assessed by the
Clay County property tax assessor for the calendar year preceding the city
elections, shall be entitled to vote in all city elections and referenda held in the
city. Pursuant to Tennessee Code Annotated, § 2-2-107, in cases of multiple
ownership of real property, no more than two (2) owners who are registered
voters shall be eligible to vote under this section.
SECTION 2. This act shall have no effect unless it is approved by a two-thirds
(2/3) vote of the legislative body of the City of Celina. Its approval or nonapproval shall
be proclaimed by the presiding officer of the City of Celina and certified to the secretary
of state.
SECTION 3. For the purpose of approving or rejecting the provisions of this act,
it shall be effective upon becoming a law, the public welfare requiring it. For all other
purposes, it shall become effective as provided in Section 2.
