Chapter 309
1                                AN ACT
2    RELATING TO PUBLIC SCHOOLS; DISTINGUISHING A STUDENT'S
3    ACADEMIC PROFICIENCY FROM THE ADEQUATE YEARLY PROGRESS OF
4    PUBLIC SCHOOLS AND SCHOOL DISTRICTS; CONFORMING RANKINGS OF
5    SCHOOLS IN NEED OF IMPROVEMENT WITH FEDERAL REQUIREMENTS;
6    PROVIDING A PROCESS FOR REOPENING FAILING SCHOOLS AS STATE-
7    CHARTERED CHARTER SCHOOLS; PROVIDING FOR THE DISAGGREGATION OF
8    DATA BY GENDER; RECONCILING MULTIPLE AMENDMENTS TO THE SAME
9    SECTION OF LAW IN LAWS 2005.

11   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
12         Section 1. Section 22-1-2 NMSA 1978 (being Laws 2003,
13   Chapter 153, Section 3, as amended by Laws 2005, Chapter 313,
14   Section 3 and by Laws 2005, Chapter 315, Section 1) is amended
15   to read:
16         22-1-2. DEFINITIONS.--As used in the Public School
17   Code:
18              A. academic proficiency means mastery of the
19   subject-matter knowledge and skills specified in state
20   academic content and performance standards for a student's
21   grade level;
22              B. adequate yearly progress means the measure
23   adopted by the department based on federal requirements to
24   assess the progress that a public school or school district or
25   the state makes toward improving student achievement;
