Chapter 315
1                                AN ACT
2    RELATING TO EDUCATION; CLARIFYING, CORRECTING AND RECONCILING
3    SECTIONS OF THE PUBLIC SCHOOL CODE TO COMPLY WITH THE
4    EDUCATION REFORM OF 20031 DEFINING TEACHER; PROVIDING FOR
5    SCREENING, MONITORING AND DIAGNOSTIC TESTING OF READING FOR
6    KINDERGARTEN THROUGH GRADE TWO; EXTENDING THE TIME OF A LEVEL
7    ONE LICENSE; PROVIDING FOR MENTORING FOR LEVEL THREE TEACHERS;
8    CLARIFYING THAT SCHOOL BOARDS APPROVE ANNUAL BUDGETS;
9    REQUIRING HEALTH EDUCATION AND PHYSICAL EDUCATION IN CERTAIN
10   GRADES; DECLARING AN EMERGENCY.

12   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
13         Section 1. Section 22-1-2 NMSA 1978 (being Laws 2003,
14   Chapter 153, Section 3, as amended) is amended to read:
15         22-1-2. DEFINITIONS.--As used in the Public School
16   Code:
17              A. adequate yearly progress means the measure
18   adopted by the department based on federal requirements to
19   assess the progress that a student, a public school or school
20   district or the state makes toward improving student
21   achievement;
22              B. commission means the public education
23   commission;
24              C. department means the public education
25   department;
