ACT

In addition to, and amendment of, an A& for the
more expeditious method of making partition of
Land,    and other real Eftate held      in   common.
IV FIE R EAS doubts having arien, whether partition of reateflate in
joint tenancy or caparcenary can be made, in the fumry mode the AM
diret7s for the partition of Land and other real 1gfate held in common
and undivided ; and as thefaid Al doth not impower the 7udge of
Probate,. in any cafe, to/ef of infeveralty, to any renant in common,
joint tenants, or parcener, the part toflich owner belonging, without
farti.. t of the whole ; which is found to be often unnecefary, and
fometimes inconvenient,
I.      E IT ENACTED BY THE S ENAT E AND FO USE op
REPRESENTATIVES, IN GENERAL-COURT
CONVENED, That the Judge of Probate, in faid A& mentioned, may
and fhall, upon application of any tenant in common, joint tenant,
or parcener of real eftate, order the part to him or her belonging, to
be divided and fet off in feveraity, without ordering a partition of
die whole among all the owners thereof, which feverance of any one
owner's part being fo made and accepted, as the faid At direas for
the partition of land and real eftate, held in common and undivided,
fhall be good and valid.
 II. AND any perfon may appeal from the decree of faid Judge,
refpe&ing the partition of fuch real ellate, to the next Supreme Court
of Probate for the county wherein the fame decree may be
made, any time Within fix months from the time of pronouncing
fuch decree.
