OF TIE
AN ACT, concerning (ie appointment, jurisdiction and powers of
Justices of the P'cace, within this State.
SEC. 1. Be it enacted by the Senate and House of Rcprescn-
'atives of the State of Mississippi ia Gencral .f1ssembl onvened,
hiat there shall be appointed and commissiog.ed, \y2Y the
Governor, on the recommendation of the county, ourf st e
petent number of Justices of the Peace, in and for ch coun-
ly in the state, not less t:an one nor more tha  1o, in Abb
cafjain's district, who shall'severally take thIoathof , ice-
prescribed by the constitution; and shall have and nsercise
all the jul4sdiction, power and authority given andlilo .(d,by
low, to Justices of the Peace, not contrary to the ccnstitution
of this state: Provided, That if the county court of any
county shali recommend any person as a Justice of the Peace,
wh'lio shall be at the time he is sorecommended,disqualified,
from any cause whatever to hold said office, by the zon'ti'u-
tion and laws of this state, or, if such person shall be mani-
festly incapable of performing the 3utics of a Justice of the
Peace, the Governor shall have authority, and he is hereby
authorized and required to return such recommendation to the
county court by which it was made, with hi. reasons thetefor,
Cnd the court shall thereupon reconsidur the same. and may
change or affirm it,as they shallthink proper; but ifthe county
court shall persist in recommending any person disqualified
as atoresaid, it shall be the duty of the Governor to withhold
-he commission from such person, and report the facts in re-
lation thereto, to the next general assembly.
SEc.2. The Justices of the Peace who nuay hereafrerbe ap-
pointed, shall continue in office during the term of three years;
Cut, for any malconduct or misdemeanor in office whatsoever
may be prosecuted by information, or presentment ofa grand
.Jury, in the circuit of the county for which he is appointed;
