Incuofscond   4. In ease of a second conviction of a master or other person
'coneletlon J~aving charge of such biut, under cither of the three preceding sue-
tions, the person for whose benefit said boat is run shalll be reslpon-
sible for the fine imposed and costs, if not paid by the-ofrender ; and
tbe'saire may be recovered, in tho court in which the conviction was
hrd, by motion, pn ten days' notice, to'be instituted by the rttorney
for the commonwealth in such court.

app huited  or navigable stream, to appoint one or more discreet persons as in-
spcctir of boats, who sha I be paid by county levy, and iho shalt
be clothed with full power and authority, upon exihiiting the order
appointing them, to exadine and search, within their respective coun-
ties, all boats eng ged in transportation on any such canal or navi-
gable stream, for the detection of stolen property, and to reuire of
the master of any boata true account of every article fiiund thlereon.
Penalty for fat- If any waster fail to render such true account, when requihcd under'
lu r         this section, he shall le fined, in the discretion of ii jury, not less
than one hundred dollars, and ii defitult of payment, he imprisoned
not exceeding six months; and if a free negro, lie shall be also pun-
ished with stripes. Any person who shall refuse to admit upoi Ila
boat, or sihall obstruct or resist any iispectr duly exhibiting his
authority, in the discharge of his duty, siill le deemed guilty of a
ftipoclor, how misdemeanor. The court may at nay time, after smlnuion to show
rt, ovod   cause against it, remove any such i spector, and iay appoint ano-

Peziasly for   1. B]e it enacted by the general assembly, that if the master or
trnn,;piriii,  any other person having charge of a canal boat, batteau or other
boat plying on the canals or rivers of the state, shall carry any
slave upon the same from one place to another within the state,
without the consent of his owner, or of the guardian or committee tqf
the owner, and iitho'ut using due efforts to arrest such slave and
lodge him in lawful custody, lie shaoll, if a free person, be prosecuted
therefor in the county in which the offence has been committed, and
shall le fined not lees than twenty-five dollars nor more than five
hundred dollars; and shall moreover, in ease the slave, is mnt re-
gained, forfeit and pay to the owner, guardian or coflmnittee of such
owner, the value of said slave, and the reasonable expenses incutred
or or boat, by himiii attempting to regain said slave; and in case the slave is
how roptoniAblo. r1gained, theni he shall forfeit and pay to the owner, guardian or
comumittee of such owner, twice the amount of 4imc1h reasonable ex-
pIenses incurred by him in regaining said slave; to be ascertained by
the jury sitting on the trial of the ease.
