Such requisition shall be apportioned ratably among tionol all the slaveholders in the several counties, cities and towns on which the requisition shall be made, so as to charge each slaveholder with the same proportion of his male slaves betw en the ages sp'ecilied, capable of performing ordinary labor, to be judged of by the court, When governor which may be demanded from his county, city or town: provided, May exemapt nouute however, that the governor, in his disecretion, may exempt wholly or partially, from the operation of this act, suel counties as may have lost so large a portion of their slaves, in consequence of their escape to the public enelny, as will materially affect the agricultural pro- ducts of such counties. And the governor may exempt such other counties as, from their geographical position or contiguity to the Peraons, how pulic enemy, lie may deem expedient. And in any county, city or elepted town partially exempted under this statute, any person who may ,satisfy its county or corporationcourt, or any person appointed by the governor for that purpose,,that lie or she lns lost one-third part of his or her slaves liable to work on the public works, by said slaves going over to the enemy, shall ie exemupted from the operation of' lionthly allew. this act.
