is required in the authentication of any paper or record necessary to
the recovery of the wages or other dues of deceased soldiers, duo to
them as soldiers; nor shall such tax be imposed upon the grant of
administration on the estate of any such decedent..
2. Be it further enacted, that the clerk of any county, corporation When refunded
or circuit court, to whom such tax hn heretofore been paid, and not
by him paid into the treasury, be authorized to refund the same to
the legal representatives of said deceased soldier.
3. This act shall be in force from its passage.              Commencement
CHMA. 41.-An ACT to organize a Military Contingent Fund.
Passed March 15,1862.
1. Be it enacted by time general assembly, that there shall he set Mtilitary contin.

called the  Military contingent flnid ;' out of which shall be paid all
expenses attending the execution of tlme military laws, which are not
otherwise provided for, or for which no special appropriations may
have been or may he made, or fifty other military expenses which the
govermnent may deem necessary find proper. No payment shall be
made out of the fuind, except upon the written order of the governor,
directed to tihe auditor of public accounts.
2. That the sum of fifty thousand dollars is hereby appropriated Amount nppro.

CHAP. 42.-An ACT to amend and reeenact an Ordhnmnco to provide for
the enrollment and employment of Fre; Negroes in the public servieu,
passed by the Convention July Ist, l61.

Be it enacted by the general assenhly, that the ordinance of the Ordlnance
convention, passed July first, eighteen hundred find sixty-one, en-mendd
titled an ordinance to provide for the enrollment and enployment of
free negroes in the public service, be amended and re-enacted so as
to read-as follows:
1. The county and corporation courts which have not enrolled, vroe negroes,

shall enroll, aA soon as practicable, all able bodied male free negroes
between the ages of eighteen and fifty, residing within their respec-
tive jurisdictions at the date of this act; which said enrollment shall
