3. If upon such examination the court shall be satisfied that there Power of court
is no fraud or collusion between the parties, and that there is no good
reason to the contrary, the said court shall have leave to grant the
application without any compensation to the commonwealth; but the
individual thus chosen master shall enter bond with approved security,
in iuch penalty as the court shall prescribe, with condition that said
negro shall not become chargeable to any county or corporation in
the cominonwealth.
4. The proceedings in such case shall be entered of record, and Proceedings,

Passed Mdarch 21, 1861.
1. Be it enacted by the general assembly, that the governor be Siaves, how
and lie is hereby authorized to pardon and restore to F. N. Fitzhugh, pardoned
or his authorized agent, two slaves Jack and Ben, condemned by the
county court of Caroline for sale and transportation; which slaves
were before their conviction the property of said Fitzhugh: pro-
vided, that the said F. N. Fitzhugh shall not be entitled to the bene-
fit of this act until le shall pay the costs and expenses incurred by
the commonwealth in the prosecution or conviction of said slaves, or
in any other manner, nor until lie or some one for him shall enter nond
into bond before the governor, payable to the commonwealth, with
good and sufficient sureties, and conditioned for the removal of said
slaves beyond the limits of the commonwealth within such time as
the governor may prescribe.
2. This act shall be in force from its passage.                Commencement
