CUAP. 202.-An ACT concerning Baldwin Foster of the county of Matthews.

Allowance to  1. Be it enacted by the general assembly, That the auditor of
Baldwin Poster
asa uard to a  public accounts be and is hereby authorized and required to issue a
convict.    warrant oil the treasury, payable out of any money therein not other-
wise appropriated, in favour of Baldwin Foster, or his legal reprc-
sentative, for the sum of nineteen dollars and nineteen cents, for
expenses paid and services rendered by him in assisting the deputy
sheriff of the county of Mlatthews in conducting to the penitentiary
(pursuant to the judgment of the circuit superior court of law and
chancery for said county, pronounced at its spring term eighteen
hundred and forty-three,) David Ripley, convicted of stealing a negro,
the property of John Arinstead.
Commencement.  2. This act shall be in force from the passing thereof.
CuAP. 203.-An ACT concerning lieutenant Edward S. Gay of the public
guard.
[Passed February 4, 1840.]
Preamble.     Whereas it is represented to the general assembly, that at a court
martial convened and held at the armory, in the City of Richmond,
in the year eighteen hundred and forty-threc, for the trial of lieute-
nant Edward S. Gay, of the public guard, upon charges and specifi.
cations preferred against him by Capt. John B. Richardson of said
guard, sentence of suspension from command for the period of three
months,with pay and emoluments stopped, was pronounced upon said
Gay, by order of said court martial, confirmed by the executive, and
carried into execution: And whereas it is deemed expediei.t and pro-
per, in consideration of the previous and subsequent good conduct
and officer-like deportment of lieutenant Gay, that a mitigation of
said sentence should be made by a restoration of the pay and emo-
luments so stopped: Therefore,
Pay and emolu-  1. Be it enacted by the general assembly, That the auditor of

Lieut. E.eS. Gy Public accounts be and is hereby authorized and directed to issue his
warrant on the treasury, payable out of any money therein not other-
wise appropriated, in favour of lieutenant Edward S. Gay, for the
sum of two hundred and twenty-two dollars and seven cents, the
amount of three months pay and emoluments, which were thus sus-
pended and stopped by order of said court martial, as if such sus-
pension had not taken place.
Commencement. 2. This act shall be in force from the passing thereof.
CuAP. 204.-An ACT allowing the payment of a sum of money to Thomas
W. Gayle.
[Passed January 14, 1840.]
