claiming the same under the sale in the preamble to this act men-
tioned, which deeds shall be delivered to the proper parties respec-
tively on the payment of the purchase money, to the use of the said
present or future executor; or if there be legal proceedings in any
case to recover the purchase money as hereinafter provided for, the
proper deed executed and certified as aforesaid, shall be filed in the
clerk's officeof the court in which such proceedings are instituted
to be delivered to the grantees when said money is paid.
Bonds, Judg- 3. And be it further enacted, That all bonds, judgments and other

given by purecbla- securities for the purchase money of said lots, shall be for the use,
e how pr- and subject to the control or the said present, or any future executor
center. of said Judith Randolph, and may be proceeded on by him in his
own name, and in the same form of action as if executed to him as
executor as aforesaid ; saving, however, to the purchasers, their heirs,
executors and administrators, all the equities which would have per-
tained to them if this act had never been passed; saving also, to said
executor and his successors, their legal title and all proper remedies
for asserting and enforcing the same to all and every of said lots for
which the purchase money shall not be paid.
Executor nutho. 4. And be it further enacted, That the said Henry St. George
lt en Tucker, executor of Judith Randolph deceased, or any future exe-
belonging to tes- cuter or administrator of said Judith Randolph, shall be and is here-
tator's estate, by authorized to sell any lot or lots in the town of Farmville, be-
longing to the estate of said Judith, whether of the survey of the
fifty acres condemned by an act passed , seventeen
hundred and ninety-eight, or by the act of the ninth of March eigh-
teen hundred and thirty-six, whether the title to the said lots was
vested by the said act of seventeen hundred and ninety-eight in the
trustees of the town of Farmville or not, and to convey a title which
shall operate as a fee simple title to said lot or lots.
Commencement. 5. This act shall be in force from the passing thereof.
CHAP. 179.-An ACT authorizing the trustees of the town of Lexington, in
the county of Rockbridge, to use the county jail for certain purposes.

county Ja i of any by-law or ordinance of said town, made under the authority
of the act, entitled an act reducing into one the several acts con-
cerning the town of Lexington, in the county of Rockbridge, passed
December the eighteenth, eighteen hundred and forty-one, or any
subsequent or other act in force upon the same subject, shall have
occasion to commit any slave, free negro or mulatto to jail, such
commitment shall be to the jail of said county of Rockbridge; and
upon any such mittimus or order of commitment, it shall be the duty
of the sergeant of said town, or other officer of said town duly au-
thorized to act under the by-laws thereof, to convey such person to
the said county jail; and the jailor thereof shall receive such person
into said jail, to be treated therein in the same manner as if com-
mitted by u justice of the peace, or other lawful authority of said
county, according to the nature of his or her offence, or cause of
Jailer's foes. commitment; and shall be liable to the payment of the same fees
and charges during his or her detention, as if committed by a justice
or other authority of the county.
