der to be brought before him, or some other justice of the peace, and
upon satisfactory proof befbre the said justice, that the person so ar-
rested has violated tile provisions of this act, the justice shall re-
cognize him to appear at the next quarterly court or circuit superior
court, to be held fbr the county in which such offence may have been
committed, to answer any inlormation, indictment or presentment
which may be filed or made against him ; and upon such informationi,
indictment or presentment, the court shall proceed to trial without
delay. All recognizances taken under this act, shall hle in a penalty Peaatty of r,-
not exceeding two hundred and fifty dollars, and shall he executed by cogiizances.

said justice shall commit him to the jail of the county.

deemed necessary by him, take with him the power of his county to
execute any writ, warrant or other process which may be directed to

hinder him in the discharge of his duty, which nagistrate shall coin-.

thereafter.
5. This act shall be in force from the passing thereof.         Commencement.
CHAP. 83.-An ACT to repeal so much of the act of the 26th Marlh 18,12,
concerning the taking of oysters in the county of Northampton, and fromo
Wilson's creek in the county of Gloucester, as applies to the county of
Northampton.
