RESOLUTIONS.
No. l.-Resolution for transmitting to the governors of the several states of
the Union certain correspondence, reports and act of assembly relative to the
controversy between this state and the state of New York.

soy as fugitives from justice on the demand of the latter; of the spe-
cial message of the governor of Virginia to the presenlt general as-
sembly on the same subject; of tile report of the special committee
to whom that message was referred ; and of the act to prevent the
citizens of New York from carrying slaves out of this commonwealth,
and to prevent the escape of' persons charged with the commission of
crime, passed by tile general assembly of Virginia on the thirteenth
day of March, eighteen lndred anti forty one, with a request that
they will lay the same before their respective legislatures.

Whereas, it appears that the governor of New York hath demanded Preamble.
of the governor of Virginia a fugitive from justice legally charged
with crime in that state, and now confined in this; and that such de-
mand hath been made in conformity with the constitution aI(1 laws
of the United States; but that the governor of this state contsiderilg
that the governor of New York has very recently refused to comply
with a similar demant upon him made by this state, has deemed it
proper to decline for the present to surrentder the said fugitive; and
while the general assembly hath full confidence that the course adop-
ted by our governor lath proceeded from an anxious and patriotic
desire to induce the state of New York to comply with her constitu-
tional obligations to this state ; yet as tile general assembly hath
solemnly protested against the conduct of that state oit the occasion
alluded to, as a palpable violation of those obligations, and has main-
tained, and still maintains, that the duty of the executive of each state
to surrender figitives legally charged with crime, when properly tie-
manded by tny other state, is one imperiously enjoined by the col-
stittition and laws:
