treasury: Pronided, That such compensation shall not exceed tile

Commencement.  3. This act shall commence and be in force from the passing
thereof.
Col't. 76.-An ACT to provide for the nppointment of a principal engineer of
the state.

Princiral ea.  1. Be it enacted In the general asscmbly, That henceforth there
near, ow elcted'. shall be a principal engincer of the state, who shall be ihinually
noard or ju,,ic elected by the general assembly. 'ei board of public works shall
worksto precribe have and exercise the same powers in prescribing the duties of such
engineer, as were given them prior to the passage of the act of the
specialIdties re- twentieth of March, eighteen hundred and thirty-two; and besides
fjuired.    the duties which may be thus prescribed, it shall particularly be the
duty of' said engineer, personally to examine, from time to time, the
condition of each work of internal improvement within the state,
unlertaken or completed wholly by the commonwealth, and of each
rail-road or canal, to the stock of which a subscription has been or
may be authorized on behalf of the state; and to make a detailed
report thereon to the said board, embracing any matter which he
niaalary, how  may deem pertinent. The said principal engineer shall receive for
paid.       his services a salary of two thousand dollars per annum, to be paid
(luarterly, out of the income of the fund for internal improvement.
F.xpoesallood. The necessary expenses of the said principal engineer in the dis-
charge of the duties of his office, shall be paid in like manner, af-
ter the accounts therefor shall have been approved by the board of
public works.
Vora  ..ow   2. le.it firt/r (e nacte(l, That if the general assembly shall fail
npj'Ihdj    to make an election at any session thereof, or if a vacancy shall
occur in tile office of principal engineer from death, resignation,
refusal to accept or any other cause, in the interval between the
meetings of the general assembly, such failure to elect shall be sup-
plied, or such vacancy shall be filled, by the board of public works;
and the person by them appointed, shall continuo in office until the
next election.
Commencement.  3. This act shall be in force from its passage.
CntAP. 77.-An ACT to provide for the opening and repair of the public roads

poilt, d.W  -  courts of this commonwealth, shall annually, at their May terms, ap-
point not less than two nor more than five discreet and intelligent
persons, residents and freeholders in their respective counties, who
oath or ounce.  shall le called  commissioners of roads, and who, before entering
upon their duties as prescribed by this act, shall take an oath be-
fore their county courts to perform them impartially, and to the best
of their skill and ability.

oplicatoi, ro  make application to any county court to have a new road opened,
alter at ul one. or a former one altered, within their county, for the convenience of
travelling to their county courthouse, to any public warehouse, land-
