ChAP. 203.-An ACT to authorize.tho corporation of:the town or Winchester
to impose and collect taxes on theatrical and other public exhibitions therein.
(Pusd February 18th, 18M3.)
Power to tax ox-  1. Be it enacted by the general asscnibly, That the president and
tor ofe     common council of the corporation 6f th town of Wiilichster, in
the county of Frederick, be, and they arc hereby, authorized and
empowered to impose and collect such tax upon exhibitors of public
shows, circuses or theatrical performances within said town, as they
may doem expodient, notwithstanding a tax may have ben paid,
and license obtained from the competent authorities ofr said county
for said corporation, under the revenue laws of this commonwealth:
Proviso.    Provi4ed, however, That such additional tax shall not exceed in any
one instance the tax on a license for such purposes, now required
by the revenue laws of this commonwealth.
Commencement.  2. This act shall'be in force front the passing thereof.
CHAP% 204.-An ACT to establish the town of Dayton, in the countyof Rock-
inghnm.

Town ao Dayton  1. Ie it cnacted by the general assembly, That not exceeding
establihl.  thirty-five acres of land, the property of Daniel Rife and others, at
the place now known as the village of Dayton, in the county of
Rockingham, shall be, and the same is hereby established a town
by the name of Dayton, as the same has been heretofore laid off
into lots, streets and alleys, and may be hereafter further laid off and
Trustees.   extended into lots, streets and alleys corresponding thereto; and that
Samuel II. Coffinan, Asher W. Tinder, Daniel Rife, Samuel BocjA
tell, Samuel Cline, John Cooper and John Allebaugh, gentlemen,
be, and they are hereby appointed trustees thereof, who shall, before
they enter upon the duties of their appointment, take an oath or
solemn aflirnation, before some justice of time peace of the county
of Rockingham, to execute the same faithfully and impartially, ac-
cording to the best of their skill and judgmuipt, any five of whom
may form a quorum and proceed to business under the authority of
this act.
Powertomakeby-  2. Be it further enacted, That the trustees of said town, or any
law,, &C.  five of them, shall be, and they are hereby empowered to make such
by-laws and ordinances for regulating the police thereof, aind for the
regular building of houses therein, as to them shall seem best, and
the same to enforce, (by reasonable fines, not exceeding in any one
offence, the sum of five dollars, recoverable with costs, before any.

the same as occasion may require: Provided however, That such
by-laws and ordinances shall not be repugnant to or inconsistent
with the constitutiofi and laws of the United States, or of this coin-
monwealth.

trustees.  five of them, shall have power to remove or abate nuisances, or
cause tile same to be done at the expense of those who cause them,
to improve and repair the public streets and alloys, to prevent and
punish by reasonable fines, recoverable as aforesaid, the practice of
firing guns and running horses in said town, to license and regulate
shows and other public exhibitions, to appoint all such officers as
may be necessary for' conducting the affairs of the said town, not
herein provided for, and to allow them such compensation as they
