bond or bonds in the name of said commissioners, by themselves,
or by any person or persons, body politic or corporate, aggrieved
by any breach of the contract or contracts entered into by the per-
son or persons, obliger or obligers in said bond, and such damages
recovered as a jury may assess, until the whole penalty of such
bond or bonds shall be assessed.
Commencement.  6. This act shall commence and be in force from the passing
thereof.
CHAP. CCXI.-An act to establish the town of Sparta in the county of Rock-
inghain.

Town or Sparta  1. le it enacted by the general assembly, That not exceeding
e,tahllhod.  ten acres of land, the property of Richard 'ickering, lying at the
Cross Roads, near Smith's creek, in the county of Rockingham,
and heretofore known as the Smith's creek post-office, shall be and
the same is hereby established a town, by the name of Sparta, so
soon as the same shall be laid off into lots, with convenient streets
Tn,,tees.  anti alleys; and that Richard Pickering, John Cowan, Samuel
Harrison, John Harrison, John Rader, senior, Abraham Martz,
Isaac Moffet, Benjamin Miller and Reuben loore, gentlemen, be
and they are hereby appointed trustees thereof, who shall, before
they enter on the duties of their appointment, take an oath before
some justice of the peace for the county of Rockingham, to exe-
cute the same faithfully and impartially, according to the best of
their skill and judgminwt, any five of whom may form a quorum and
proceed to business under the authority of this act.
Power to make  2. Be it further enacted, That the trustees of said town, or any
by-laws.  five of them, shall be, and they are hereby empowered to makb
such by-laws and ordinances for regulating the police thereol and
for the regular building of houses therein, as to them shall seem
best, and the same to amend, cnlbrce, alter or repeal : Provided,
however, That such by-laws and ordinances shall not be repugnant
to or inconsistent with the constitution and laws of the United
States or of this commonwealth.
aeneral powers or 3. Be it further enacted, That the trustees of said town, or any
trustoee.  five of them, shall have power to remove or abate nuisances, or
cause the same to be done at the expensp of those who cause them ;I
to improve and repair the public streets and alleys; to prevent and
punish, by reasonable fines, the practice of firing guns anti running
horses in said town; to license and regulate shows and other pub-
lie exhibitions; to appoint all such officers as may be necessary for
conducting the affairs of the said town, and to allow them such
compensation as they may deem reasonable, and to do, or cause to
be done, all other things necessary or proper for the general good of
said town, within the limits of the powers conferred by this act:
and to enable the said trustees to carry into effect the said powers,
they are hereby authorized, annually, to levy a tax, if deemed ne-
cessary, on the houses, lots, slaves and horses, and tithables within
the limits of said town ; and to appoint a clerk and collector, (tak-
ing from the latter bond and security for the due and faithful dis-
charge of his duties, as they shall be prescribed by the said trustees:)
