3. Be it fuarther enacted, rhat, if any free negro or in ulatto, Paihinent l ol.

the value of ten dollars, the stealing whereof is made felony by
law, and shall have been convicted thereof at any time, and son-
tenced to the punislmelnt prescribed by the alresaid third sec-
tion of the above recited act, it shall be lawful aia the Executive
of this Commonwealth, with tile consent of the person so coil-

nishinent as may be deemed more proper. And the Executive
