hanmiock river at Falmouth, or the causeway adjoining thereto on

the sit In of li ve dol arsn, recoverable by warrant beftre any justice
of the peace for the county of Shl'hid, one tnoiety to the use of
the prosecutor, and the oilier to the Commonwealth for the use
of the literary fund ; and if the oilfhuder be a slave, lie shall be
punished with any number of stripes on his or her bare back, at
the discretion of any justice of the peace of the said county, not
exceeding thirty-nine lashes, unless his or her master, mistress,
or employer shall pay to the justice before whomi such slave may
lie brought, the atnount of fine imposed on free persons for like
ollhnces ; which fine shall. in that case, be paid to the overseers of
the poor of the said county, for the use of tile same.
