ed for eighteen . months, unless the -President of the United
States shall, before the expiration ofthat time,. declare the deter-
ruination of the genaral govermen; to deln  the privilege ten-
dered by an actof this session, to open an inland navigation from.
the port of Norfolk to Currituck sound, whercupon the fIower
and authority hereby given shall immediately commence : but -if
the president shall, within tht period aforesaid, declare tlhe de-
terminatidn of the general governnment to open an inlnd:iaviga-
tion between the points aforesaid, according to-the  privilege ten-
dered to them by the act afor~said,. thejiall- power an' aotthorl-
ty hereby granted, shall immediately cease and bedetermined:
Andprovided also, That the president and directors aforesaid, shall
once in every three years, make . areport to the ,governor and
council of this commonwealth, of the statewoftheprofits arising
from the said canal, and shall mtdreiver, if rcquired by' the go-
vern6r and council, submit their original books to &h'exaiiiiiiati-
on of such persons, as shall be by the governor ad-,cbdn'iti a-
aforesaid, appointed for that purpose ; and if upon such re-
port or'examination, it :shall appear that the anual profits
of the said company have exceeded ten per centitm, it shall
be the duty of the said'president and directors to pay the sur.

priation by the legislature thereof: and if the said president and
directors shall at any time fall to pay such suplus into -the pub-
lic treasury, according to the direction of this act, it shall be law-
ful for the auditor, on ten days notice to the president of the
said company, to recover such surplui, on motion to the judges
of the g'nerol court: Prooided always, That the two years
allowed by this act, wthinwhich thrr subscriptions are directed.
