Be it enactCd by the General Assembly of the Stale of' Tennessee, That the inhabitants of the city oflneorporatioa. Chattanooga, are hereby constituted a corporation and body politic, by the name and style of the Mayor and Aldermen of the city of Chattanooga, and by the same name shall have perpetual succession, may sue and be sued, plead and be impleaded, in all courts of law and equity, and in all actions whatsoever, may purchase, receive and hold property, real and personal, within said city, and may sell, lease, dr dispose of the same for the benefit of said city, and may purchase, receive and hold property, real and personal, beyond the limits of the city, to be used for the burial of the dead, for the erection of' water-works, fir the establish- inent of a hospital, poor house, work house or house of correction, and may sell, lease, or dispose of said property for the benefit of' the city, and do all other acts touching the same as natural persons, and shall have and use a common seal and change it at ploasure. SEc. 2. The boundary of the city shall be as follows: Beginning at the north-east corner of the south-west noundares. fractional quarter of fractional section twenty-one, second fiactional township, fourth range west of' the basis line in the Ococe district, thence south twenty west to the south-cast corner of' the north-west quarter of section thirty-three, thence north seventy, west to the middle of' the Tennessee (Uver, thence up the middle of' the river to a point opposite the beginning, then in a direct line to the beginning: Provided how- ever that the ano included, outside of' the present boundary of Chattanooga, shall not be subject to a corporation tax while held as woodland or for farming purposes, but iay be taxed, whenever laid ofl' and sold Or occupied as town lots. Sc. 3. There shall be a city council to consist of a Mayor and Aldermen. The board of Alder- Mayor and Al men shall consist of' two members from each ward, dormen. chosen by the qualified voters of each ward respectively for one year. No person shall be an Alderman, unless he be a citizen of' the state of Tennessee and a bona fide residcnt and a free holder in the ward for which he is elected, any Alderman after his election, renmov- ing from, or ceasing to be a free holder in his ward, shall thereby vacate his said oflice.
