mianner as if the deponent oit deponents were dead or
out of the state.
Sec. 2. Be it enacted, That whero depositions are an-
thorised to be taken by this act, it shall be lawful for NOticC
the clerk ofthe court, where said cause may be peinding
on the application of either party or their attariney,
tp issue a commission for taking said depositions vL-
ther in or out ofterin time, and if out of terim time with-
olan oryser of court, specifyiig in said commissioii the
Ijuumber of days notice that shall'be given for taking the
same, whick shall be as follows (to wit:) fow fifty milcs
or under, five days ; frot fifty to one hundredd miles,
ten days ; any distance over one hundred, not excecd-
ipg one hundred and fifty, fifteep days ; 'if over one
hundred anid fifty, not exceeding two hundred and fif-:
tji miles, twenty days; if over two hundred 'upd fifty,
thirty dayq.
Sec. 3 Be itenacled, That if any party or parties, Dennsitions
