CHAP. CIY.
AN JCT regulating the procedings in certain suits
therein specified.
Sec. 1. BE it enacted by the General Assembinly of the In suits for
State of Tennessee, That in every instance where an freedom de-
action hati been commenced by any person, or when fendantpro-
any person may wish to commence such action, forthe lnibited from
purpose of trying his or her title or right to freedom,  din cff
it shall be a duty of the court, or anyjudge thereof in
vacation, or any twojustices of the peace, at any time,
pending such suit, to require of the defendant in such
action, good and sullicient security, that the person
claiming his or her freedom, shall not be run of', re-
noved, taken or sent out of the limits of this state, but
that such person shall be kept within the limits of the
county until such cause is finally determined: Provid.
ed always, that snch court, or judge, before requiring
such bond'and security, shall be satisfied by the affida.
vit of some respectable person, or otherwise, that
there is probable reason to believe that such person is
entitled to freedom.
Sec. 2. Be it enacted, That in every case where an
order shall have been made for bond and security, Sheriffincer
that it shall be the duty of thesheriff, to take such plain- tai casesto
tiff into his custody, and take care of him or her, until intosafe kee
such bond and security shall have been given, or until ping.
such cause shall be determined.
Soc. 3. Be it enacted, That this act shall be in force
from and after the passing thereof.
