Au ACT      appointing   commiflioners to fix oi a
place to eret a court houle, prifon and fiocke
in'Smith county.
SECTION 1. BE it enacted by the General 4enibly of the
State of 7ennefee, That-James Draper,
Jame Guinne, John Garden, joicph Coflems, and Henry
Tooley be and the.y are hereby appointed commiflioncrs,
and they, or a majority of them, are authorifed to fix on
a place on Cumberland river, not below Bledfoeborough,
nor above the mouth of the Caney Fork, fort he purpofo
ofereding a court houfe, prifon and flocks.
Sec. 2. Be it enacted, That the laid - coimil-ioners are
hereby authorifed to purchafe fortyacres of land on faid
Cumberland river, within the bounds aforefaid, on the mofi
reafonable terms, having regard to fituation and water, on
fame part of which fhall be eraed the court houfc, prifon
and flocks for the ufe of laid county, and the faid commifli-
oners or a majerity of them, fhall take a deed in fee fimple
in trut for the c6unty to themfelves and their fuccelors
in office for the ufe and benefit aforefaid, and fhall as foon
as may b., after purchafing and obtaining a tide thercto
procaed to lay Off a town thereon to be called and known
by the name of Livinglion, provided it benot at Bledfoebo-
rough, referving two acres for public ufes in or near the
center thereof, on which fhlil be ereaed the court hofife.,

denominated the public fquate.
S:. 1, Be it enacted, That thc thid comnillionrs or 4
