of shoriff of any couity in this State by the people, or the
justices of the county court, shall be unable to tender his
honds and qualify by taking the prescribo oaths at the torm
of the county court at which the election is mado or do-
clared, by reason of' being absent in the military service
of the country, or within the enemy's lince, or by reason of
his county or a portion of it being in the possossion of the
eneiy, or by roason of the court not being held or being
dispersed by an actual or apprehended invasion or raid of
the enemy, the person so elected sheriff shall be allowed to
tender his bonds and take the prescribed oaths before twelve
justices of the peace of the county, at the oflico of the clerk
or the county court of said co.unty within twenty days after
the term of the court at which said election shall have been
made or declared, which shall be duly recorded by the clerk
of the county court.
SEC. 2. Be it further enacted, That this act shall be in
force from and after its ratification. [Ratijled the Sh day

Be it enacted by the General Assembly of the State of runishnmnt oif
Nort-Curolina, and it is hereby enacted by the authority of ',annughte
the same,. That any slave or fre person of color convicted or retony.
of manslaughter or for folony for which the punishwont
shall not be prescribed, or if prescribed the same shall not
be in whole or in part whipping, may in the discretion f
the court, be punished with one or more public whippings,
not exceeding thirty-nino lashes each, either in additfn to
or in lien of such other punishment or some part thereof as
may be inflicted for each offence. [Raifled the 11th day
of .December, 1863.]
