in comnnon fonm the testimony of one witness shall be suf-
ficient to prove the due execution thereof whenever it may
appear to the court that the other witnesses reside beyond
the limits of the State or from bodily infirmity are unable
to attend court.  [Ratified (he 19thi dy of September,
1801.

organiation.  SEc. 1. Be it enacted by the General Assembly of the
State oJ North Carolina, and it is hereby enacted by the
authority of the same, That the militia organization of the
State shall be as follows: One Adjutant and Inspector
4Gheneral, with the rank of M0jor-General, who shall be
G4eneral-in -Chief of all the forces of the State of North
Carolina ; such Brigadier-Generals as may be necessary to
communu brigades of not less than two nor more than six
regiments, the regiments now established by law, and
until otherwise ordered, the following shall be the es-
tablished brigades and regiments, viz:
