AN ACT TO DECLARE WHAT SHALL 111 SUFFICIENT TO CONSTITUTE THE Chap 30i
CRIMES OF RAPE, CARNALLY KNOWING AND ABUSING A FEMALE CHILD
UNDER THE AGE OF TEN YEARS, AND IUGGERY.
WHEREAS, upon trials for the criies of rape, carnally rreamsbo.
knowing and abusing female children under ten years of
age and buggery, offenders frequently escape by reason of
the diffleulty of the proof which has been required of the
completion of those several crimes, for remedy whereof,
SECTION 1. Be it enacted by the General Assembly of the eroor.
State of North-Carolina and it is hereby enacted by the
authority of the same, That it shall not be necessary upon
the trial of any indictment, for any of the above named
offences, to prove the actual emission of seed in order to
constitute the offence, but the offence shall be deemed and
taken in law to be complete upon proof of penetration
. only.
SEc. 2. That this act shall be in force from and after
its ratification. [Ratified the 22d day of February, 1861.]
